Welcome to C. Foster Art. By accessing or using this website and/or purchasing artwork, prints, or services from us, you agree to these Terms of Service (“Terms”). If you do not agree, please do not use the site.

1) Use of the website
You agree to use this website for lawful purposes only. You may not:

attempt to interfere with the site’s security or functionality

scrape, copy, or harvest content from the site without permission

use the site in a way that violates applicable laws or regulations
We may update or change the website at any time without notice.
2) Product information and availability
We make every effort to display artwork and product information accurately. However:

Colors may appear slightly different on screen due to monitor and device settings.

Inventory and availability can change quickly.

In the event of an error (including pricing, availability, or description), we may correct the error and cancel or adjust the order as needed. If we cancel an order, we will issue a refund.
3) Orders and payments
By placing an order, you confirm that:

the information you provide is accurate and complete

you are authorized to use the payment method provided
Orders are not considered final until payment has been successfully processed. We reserve the right to refuse or cancel any order for any reason, including suspected fraud or misuse.
4) Shipping and delivery
Shipping locations
We ship to Canada, the United States, and internationally.
Processing time
Original artwork typically ships within 3–5 business days and ships whenever ready.
Estimated delivery time
Delivery is typically 2–3 weeks, depending on whether the artwork is delivered locally or shipped. If shipped, you will receive a tracking number once the order has been fulfilled.
Shipping costs

Canada: Free shipping

United States (originals):

$65 flat rate for pieces 320 square inches and under
-
$100 flat rate for pieces over 320 square inches

International: Shipping is by quote. Please contact us for an estimate.
Carrier and tracking
We ship using Canada Post. Tracking is provided, and the tracking number will be shared when available.
Insurance and signature
-
We provide liability coverage for items over $650.

Signature is not required unless requested by the customer in the Additional Notes at checkout. Additional shipping services may require added fees.
Customs, duties, and taxes
For shipments outside Canada, buyers are responsible for any customs duties, import taxes, or fees imposed by their country. These charges are not included in the item price or shipping cost. Customs delays are beyond our control and may affect delivery timelines.
5) Returns, cancellations, and address changes
Returns (original artwork)
Returns are accepted only if:

the return is shipped back within 3 days of the original delivery date, and
-
you provide a tracking number
Return shipping costs (including any unpaid duties) are the responsibility of the purchaser. Returned items must be packed safely and returned in the same condition as received.
Cancellations
Cancellations are allowed within 24 hours of purchase.
Address changes
Shipping address changes can be made only if the order has not shipped.
6) Damage in transit
If your artwork arrives damaged, please contact us within 48 hours of delivery with:

photographs of the packaging
-
photographs of the artwork damage
-
a photo of the shipping label
Please keep all packaging materials.
We will work with you to resolve the issue on a case-by-case basis, which may include a replacement print, store credit, or other options.
7) Commissions
Commissioned work is offered on a limited basis and is subject to availability.
A commission typically includes:

an initial discussion about your subject and reference material
-
written confirmation of the process and expectations
-
scheduled progress check-ins
-
final delivery of the finished piece ready to hang, with appropriate drying time, varnishing, and hanging materials
-
a certificate of authenticity
Most commissions require a 50% deposit to reserve time and begin work, with the remaining balance due upon pickup or delivery (unless otherwise agreed in writing).

8) Intellectual property and copyright
All rights reserved.
Copyright to all artwork is at all times, even after purchase, the sole property of C. Foster. The artwork, images, and contents of this site may not be copied, collected, reproduced, distributed, or used in any other way for personal or professional gain without express written permission from C. Foster.
Purchasing artwork does not transfer copyright. You are purchasing the physical artwork (or print), not the rights to reproduce it.
9) Permission to use images
We may photograph or display artwork (including commissioned work) and may share images of finished pieces or progress images in our portfolio, website, or marketing unless otherwise agreed in writing.
10) Limitation of liability
To the maximum extent permitted by law, C. Foster Art will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the site, products, or services.
Our total liability for any claim related to a purchase is limited to the amount paid for the product in question.
11) Privacy
Your use of the site is also governed by our Privacy Policy.
12) Changes to these Terms
We may update these Terms from time to time. Updates will be posted on this page with a revised effective date. Continued use of the site after changes are posted constitutes acceptance of the updated Terms.
